“Mistress” Uses Deceased Lover’s Frozen Sperm to Have a Child in Attempt to Claim Inheritance from Legal Wife

She shamelessly filed a lawsuit demanding that the legal wife of the deceased share the inheritance — including insurance benefits and company shares.

According to Guangzhou Daily, this inheritance dispute has sparked widespread outrage across China.

The central figure is Ms. Leng, a woman from Guangdong Province, who filed a lawsuit against the wife of her deceased lover, Mr. Wen, to demand inheritance rights on behalf of the child she conceived using Wen’s frozen sperm.

Mr. Wen died in a car accident in January 2021.

Prior to that, Leng — his mistress — had secretly stored Wen’s sperm at a private clinic without his legal consent.

In December 2021, she gave birth to a baby boy named Xiaowen, conceived using the frozen sperm.

What’s especially controversial is that Mr. Wen was still legally married at the time of his death, and there were no legal documents showing that he consented to either the sperm preservation or its use.

In August 2023, Leng, acting on behalf of baby Xiaowen, filed a lawsuit demanding that Mr. Wen’s wife share the inheritance — which includes insurance payouts and company shares — with her son.

She demanded entitlements including: life insurance payouts, company shares where Mr. Wen was a shareholder, and other assets he had left behind.

According to multiple sources, Mr. Wen’s legal wife was completely unaware that her husband’s sperm had been stored — let alone the existence of the child named Xiaowen.

During the court hearing, Leng was unable to provide any legal proof that the sperm she used belonged to Mr. Wen.

She also had no documentation or written consent showing that Wen had ever agreed for her to use his sperm to have a child.

As a result, the court rejected her request for inheritance and also did not recognize the child as Mr. Wen’s legal heir.

Feng Qinjuan, a lawyer from Tahota Law Firm in Beijing, explained that under China’s Civil Code, enacted in 2021, any fetus still living in the mother’s womb has inheritance rights. However, whether a child born from frozen embryos or sperm is entitled to such rights remains unclear, as no law currently governs this specific matter.

Meanwhile, lawyer Huang Dehao from Zhonglun W&D Law Firm in Zhengzhou stated that conceiving a child using frozen sperm at a qualified private clinic is legal, but the consent of the sperm donor is required.

The incident sparked outrage on Chinese social media, particularly on Weibo, where many users condemned Leng’s actions as shameless and morally wrong:

“A woman can do anything for money.”

“That poor child wasn’t born out of love, but out of a desire to claim inheritance.”

“I hope the wife sues her back for defamation and violating her rights.”
