Despite Tom Rodriguez openly sharing his new and seemingly happy family with the public, some people — especially fans of Carla Abellana — have expressed strong negative reactions. For them, what Tom did was a clear sign of disrespect and an insult to Carla, particularly because he made his new family public when his marriage to Carla has supposedly not yet been annulled.

According to Carla’s fans, this public declaration of a new relationship could be grounds for a legal case. They claim it could be considered marital infidelity — a punishable crime in the Philippines. Under Philippine law, a married man or woman who engages in a relationship with another person can be charged with adultery or concubinage.

As long as a court has not issued a final judgment annulling the marriage, neither spouse is legally free to be with another partner — especially to have a child with someone else. Furthermore, the woman involved with the married man can also be sued for adultery if she is aware of his marital status.

However, under the law, the man’s mistress cannot be jailed. Instead, she can face a legal restriction known as destierro, which prohibits her from going to places listed in a court order — not less than 25 km and not more than 250 km from a specified location.

Still, there are scenarios where the man — in this case, Tom Rodriguez — could avoid legal consequences. For instance, if he and Carla had a proper legal agreement or mutual consent regarding their separation, and if this was properly documented, Tom may be safe from charges. But if no such agreement exists and the annulment hasn’t been finalized, he may be at risk of being sued.

Ultimately, whether or not Tom will face a case depends on Carla. If she chooses to press charges and hold him accountable for infidelity, a case could proceed. However, some of Tom’s fans believe it’s unlikely that Carla will take legal action. They argue that if she does, it might come across as bitterness toward her ex-husband’s new relationship.
